ATTOJRNEY GENERAL
January 28, 1971
Honorable W. 0. Williams Opinion No. M-764-A
County Auditor
Grayson County Re: Maximum compensation of
Sherman, Texas 75090 deputy sheriffs and related
questions.
Dear Mr. Williams:
In Attorney General's Opinion M-764, dated December 29, 1970,
addressed to you, certain errors in calculation of the compensation of
deputy clerks and assistants were made which are by this opinion cor-
rected.
In Attorney General's Opinion M-764, a 25% increase under the
provisions of Section 2 of Article 3912g, Vernon's Civil Statutes, was
applied, rather than a 35% increase authorized therein. Therefore, the
maximum compensation of the chief deputy sheriff is $9, 964. 49, rather
than $9, 226. 41, and the maximum compensation of other deputies is
$8, 736.96, rather than $8, 073. 11.
Furthermore, in calculating the compensation of assistant county
attorneys an erroneous base pay was applied. The base pay of assistant
county attorneys of Grayson County is fixed by the provisions of Article
331c, Vernon's Civil Statutes. Under these provisions the base compensa-
tion of two assistant county attorneys is $3, 600. 00 per annum and the base
compensation of other assistants is $2, 400. 00 per annum. Applying the
correct base pay the maximum compensation of two assistant county at-
torneys is $14, 965. 01 and the maximum compensation of other assistant
county attorneys is $9, 964. 49.
Attorney General's Opinion M-764 is ac ordingly so modified.
Y r very truly,
AWF RD C. MARTIN
Attorn General of Texas
