93-72    EMERGENCY COMNUNICATIONS DISTRICT LAW: A municipa I I
is authorized by T.C.A. 57-86-101 et ases. to creast a
municipal emergency communications district without
the approval of a county-wide emergency communicatimn
district in which the municipality is located. Th
authorizing referendum should be held within fhe
municipality and a municipal emergency commununications
district, once created, will be excluded from the
service area of the county-wide district. Thus, Ihui
municipal disLrict will be entitled to user feew,
generated within its boundaries to the exclusion of
the existing county-wide district, and the county-wide
district will retain no obligations within the
boundaries of the new municipal district, beyond the
obligation of both districts to coordinate their
efforts to ensure prompt, efficient service to all the

93-73    CONFLICT OF INTEREST:County Officials: Under T.C.A.
§12-4-101, an official is directly interested in any
contract between the governmental entity he or she
serves and the official personally, and between the
governmental entity and any business in which such
official is the sole proprietor, partner, or person
having the controlling interest. Controllino
interest includes the individual with the ownership
or control of the largest number of outstanding shate.s
owned by any single individual or corporation. Unide'r
T.C.A. §12-4-101(b), an official is indirectly
interested in any contract of the governmental ntity
he or she serves in which the officer is interested
but not directly so, but includes contracts where th.
officer is directly interested but is the sole
supplier of goods or services in a municipality or
county. A county commissioner is indirectly
interested in any contract between the county and a
family member (as in medical insurance coverage when a
family member or spouse receive the benefit of
county-paid premiums), if the official and the family
member commingle assets. Such indirect interest in
unlawful unless the officer publicly acknowledges his
