89-133   CIVIL RIGHTS-PRISONERS: A county government is
responsible for providing prisoners sentenced to the
county workhouse with medical care when needed;
however, if the prisoner is indigent, the
responsibility for payment of those medical expenses
should be decided between the county and the medical
provider; the state is liable for expenses incurred
from emergency hospitalization and medical treatment
rendered to any state prisoner incarcerated in the
county workhouse; however, with respect to
non-emergency medical expenses, the payment of those
expenses for indigent state prisoners is a matter to
be resolved between the county and the medical care
provider; regardless of who pays, a prisoner is
entitled to medical care, and the government agency,
in whose custody the prisoner is placed, is
responsible for insuring that the prisoner obtains any
such needed medical care. U.S. Const. Amend. XIV;
T.C.A. §41-4-115.
