Dear Citizens:
The investigations into your Open Meetings Act (OMA) complaints filed against
the Charlestown Town Council (Town Council) are complete. Because your complaints
concern the same June 6, 2001 meeting, and since many of your allegations concern thc
same subject-matter, we have addressed all of your allegations within this finding. The
first part of this finding examines the allegations common to all your complaints,
thereafter, we shall address the remaining individualized concerns.
I.    Common Allegations
Your complaints allege that the Town Council violated the OMA by convening
into executive session June 6, 2001 to discuss the Town Administrator's job performance,
despite your assertions that the Town Administrator requested that the discussion occur in
open session.  See R.I. Gen. Laws § 42-46-5(a)(1)(job performance discussion
appropriate for executive session provided that such person or persons affected shall
