Dear Mr. Kenison:
I write in response to your letter of February 24, 1993 in
which you requested advice concerning the applicability of the
Right to Know Law to the Department's public informational
meetings. Your inquiry was prompted by the Town of Belmont's
letter dated February 12, 1993, which stated that the Belmont
Board of Selectmen, Planning Board, Zoning Board of Adjustment,
and Fire Department planned to individually post notice of the
Department's public informational meeting for the purposes of
complying with State law.
The Right to Know Law defines a meeting to be:
the convening of a quorum of the membership
of a public body... to discuss or act upon a
matter or matters over which the public body
has supervision, control, jurisdiction, or
advisory power.
RSA 91-A:2, I.
In my opinion, this definition is broad enough to include
the attendance by a municipal board of selectmen or planning
board at a public informational meeting sponsored by the
Department, where a quorum of the board is meeting with the
Department to give advice concerning a highway project.
