ManagementAuthority'slegalabilitytopursuedecay-in-storage(DIS)asamethodofmanaging
low-levelradioa ctivewaste(LLRW)withintheframeworkoftheAuthority'senablingact(Chapter
104G). Inconsideringthisresponse,keepinmindthatitdoesnotaddresseitherthetechnicalo  r
economicfeasibilityofpursuingsuchanoption,oranyregulatoryaccepta  nceofthesame.Moreover,
this response assumes DIS will be treated as a waste management method different from th  e
permanentdisposalcontemplatedinChapter 1 04Gandelsewhere.
While the primary purpose of Chapter 104G and thereby the Authority is to site, build
operateandclos ealow-levelradioactivewastedisposalfacility,theActprovidesenoughflexibility
toe xploreotheroptionsifnecessarytosolvetheurgentproblemoflow-levelradioactivewast  e
management. SeeN.C.G.S.§§104G-3,-4,and-6(a)(22).
Like ot her related statutes ',Chapter 104G expressly distinguishes between a low-level
radioactivewaste facilityandalow-levelra  dioactivewaste disposalfacility.N.C.G.S.§§104G-
