Re:    Mileage for Court Reporters
You have asked for our opinion as follo s:
I spoke with you about the Court Reporter's mileage from their home to
primary place of employment. Judge Prichard asked that I get a written
opinion from you on this matter. The Court Reporters of the 15th District do
not have a primary place of employment. They all work at home on their
transcripts, etc., when they are not in the courtroom.
We issued an opinion to Jeffery Hollimon dated 4-27-95, copy attached, which stated that
under 9-13-9(6) a court reporter may not claim and be paid mileage expenses for travel
from the court reporter's home to his primary place of employment or 'main office'. The
facts of the request from Mr. Hollimon were that the court reporter had a main office at the
Forrest County Courthouse. As you stated on the phone, the court reporters in question
herein work out of their homes, and their equipment is kept at home. If a court reporter has
no office provided by the courts or counties in his circuit court district, and his main office
