     This is in reply to your  request for an opinlon, reanin
as follows:

          The  ,tate board of rediation, which
          operates under house  bill No, 180,
          effective  'eptemober 10, 1947, has
          requested an oKficial  opinion from
          the Attorney General  to the following
          question:

           can the :',tate oard of 1ediation law-
          fully compel the utility  and the em-
          ployees to pay the  cost of the public
          hearin_ panel members,  where co- pulsory
          arbitration has been  ordered by the
          board, as set out  in section 14, 15, 16,
          17 and 18 of the Act?

          I wish to call your  attention to the
          appropriation for the  ;tate board of
          z.ediation, Dection 9,3-0, pao  177 which
          includes the followin, lanjuage:     0..
          and othor necessary  expenses of the
          tate  Board of  :ediation, includin-; the
          per diem ard necessary  expenses of es-
          pcially  appointed panel ncibers  as
          provided by law.v   I d-o not find in the
          Act the directive  tiat we should pay the
          special panel menbers  per diem and ox-
          penses; therefore, before  doin  so, would
          like to have the opinion  of your depart-
          m1ent as to our authority to pay the special
          panel mmci-bers out oU state funds, or whether
