Dear Sir:


          ocoeipt  of your -ocont requot   rogarding Section
25, Article V,  Constitution of  isisoLui, 1945, is horeby
acknowledged,  which reads as follows:

             According to the abovo described  8Oc-
             tion of the Constitution,  it is provided
             that 'P'robate Judgos shall be at least
             25 years and Iiiag;istratos at least 22
             years of ago,  'vory judge  and iMagis-
             trato shall bo liconsod  to practico law
             in this Itato, oxcopt that  Probate Judges
             now in offico nay succeod  themselvos as
             Proba to Judges wi thout being so licensed,'

             Undor the abovo provision  is a pornon who
             formorly hold the off ice of Probato Judge
             but is now not in office  eli-ible to hold
             the office of Probate Judre   jin a (ounty
             under 12,000 population?

          {ection  25, Article V, Constitution  of Lissouri, 1945,

             Judges of the supremo  court and courts
             of appoals shall have boon  citizons of
             the Unitod 8tatoo for at  least fifteen
             years, and qualifiod voters  of this-state
             for nino years noxt pocdlnr their oelec-
             tion. Such judges shall be  at loast thirty
             0ears of ago but shall not  continue to
             hold of['ice ator attaining  sovonty five
