To the Indiana General Assembly
July 1, 2013 through June 30, 2014
Pursuant to Ind. Code § 5-14-4-12, the Indiana Public Access Counselor (PAC) hereby
submits this annual report of activities for the time period covering July 1, 2013 through June 30,
2014.1 This report is presented in three parts: in Part I a narrative summary of the activities of the
PAC; in Part 11 the information required to be submitted pursuant to Ind. Code § 5-14-4-12; and in
Part III appendices listing presentations given and advisory opinions issued in the past year.
PART I
Annual Report Narrative
Public Access Counselor and Staff
On August 27, 2013, Public Access Counselor Joe Hoage resigned to accept a position with
the Indiana Department of Natural Resources. Subsequently, Governor Pence appointed Luke H.
Britt to serve as Public Access Counselor for the balance of his term. Counselor Britt's term
expires on July 1, 2015. The PAC also employs a legal assistant, Mrs. Dale Brewer, who was
granted full-time status in late 2013. The Office also utilizes the assistance of seasonal interns.
Advisory Opinions
From July 1, 2013 to June 30, 2014, the PAC anticipates issuing 320 written advisory
opinions in response to formal complaints (10 are pending at the time of the submission of this
report). See Ind. Code 5-14-5 regarding the complaint process. Pursuant to Ind. Code § 5-14-5-9,
an advisory opinion must be issued within thirty calendar days of receipt of a formal complaint.
One-hundred percent of opinions met that benchmark and 95% of opinions were issued within thirty
business days. The deadline for priority complaints is seven days. See Ind. Code § 5-14-5-10; 62
IAC 1. See Appendix B for a detailed list.
Informal Opinions
In addition to advisory opinions in response to formal complaints, the PAC issues written
informal opinions pursuant to Ind. Code § 5-14-4-10(5). The PAC issued fifty-four (54) informal
opinions for the period July 1, 2013 to June 30, 2014.
Telephone and Electronic Mail Inquiries
From July 1, 2012 to June 30, 2013, the two PAC staff members received and responded to
3003 inquiries via telephone and electronic mail, as compared to 2762 in FY 2013 and 1580
inquiries received in FY 2012. Approximately 98% of all general inquiries were responded to
within 48 hours. The remaining 2% were due to weekends, holidays and out-of-office time.
