OFFICIAL OPINION NO. 89-1
Dear Mayor Helmke:
This is in response to your request for an opinion concern-
ing the following question:
Is the day of a special election to
elect a Representative in the United States
Congress to be treated as a legal holiday
pursuant to Indiana Code Sections 1-1-9-1,
3-10-8-5 and 3-10-8-6?
ANALYSIS
Indiana Code Section 3-10-8-5 reads:
Special elections are governed by other
provisions of this title as far as applica-
ble.  However, candidates in special elec-
tions shall be nominated in the same manner
as candidates are nominated to fill vacancies
on the ballot under IC 3-13-1.
Indiana Code Section 3-10-8-6 reads:
If a political subdivision holds a spe-
cial election at a time other than the t ime
of a general election, the election shall be
held in accordance with this title.     Each
county election board and other local public
official who is required to perform any
duties in connection with a general election
