Do appointed and elected officials come
within the .meaning of the term municipal
employees as used in 30 Del. C., §5165(b)(1)?
Yes, appointed and elected officials qualify
as 11municipal employees within the meaning
of 30 Del. C., §5165. Accordingly, they
must beTonded in the full amount of street
aid funds under their control.

Pursuant to 30 Del. C., Chapter 51, Subchapter 3,
the State of Delaware has established a Municipal Street
Aid Fund, the proceeds of which are made available to the
State's various municipalities for the purpose of improving
local streets and associated equipment. To establish and
retain eligibility for these funds, each municipality must
furnish evidence that the municipal employees authorized to
expend such funds are bonded in amounts at least equal to
the funds available to such municipalities. (30 Del. C.,
§5165(b)(1))
