Re: Dissemination of Title, Registration,
Driver License and Driver Performance
Records by the Division of Motor Vehicles
Pursuant to 21 Del. C. Sec. 305
Dear Mr. Shahan:
You have asked whether it is appropriate for the
Division of Motor Vehicles to disseminate vehicle title,
vehicle registration, driver license, and driver perfor-
mance records in the offices of the Division of Motor
Vehicles to law enforcement officers under 21 Del. C. Sec.
305 when these records are then further disseminated by the
law enforcement officers to persons or agencies which may
not be entitled to them under Section 305. For the follow-
ing reasons, we believe that the Division must provide that
information to law enforcement officers.
Twenty-one Del. C. Sec. 305(a) reads in pertinent part
as follows:
All vehicle title, vehicle registra-
tion, driver license and driver perfor-
mance records, which are three years
old or less in the offices of the
Division of Motor Vehicles shall be
made available to the following named
persons or agencies:
(1) Governor; Lt. Governor; members of
the General Assembly; Secretary of
Public Safety, law enforcement offi-
cers; members of the judiciary; proba-
tion officers; governmental agencies
