Dear Secretary Hayward:
You have asked for clarification of several issues arising
from the implementation of 31 Del. C. sec. 309 and required
criminal history information checks. Specifically, you have
asked:
1. Whether adoptive parents who are not residents of the
State of Delaware must comply with 31 Del. C. sec. 309 when
seeking to adopt Delaware children? If yes, then may these
adoptive parents utilize similar criminal history information
from their home states?
2. Whether foster parents in other states, with whom
Delaware children are placed, must comply with 31 Del. C. sec.
309?
3. Whether a juvenile record of a delinquency adjudica-
tion for a sexually related offense against children or
