Re: Bank Affinity Cards
Opinion No. 88-1001
Dear Commissioner Davis:
You have asked whether a proposed plan commonly
known as an affinity card violates the Campaign Financing
Act, 15 Del. C. c. 80. For the reasons discussed below, it
appears that the proposed contract is an arm's length,
commercial transaction and not a contribution under the Act.
Therefore, the plan is not illegal, per se.
In essence, the proposed arrangement is as follows:
The Delaware Democratic Party would contract with a credit
card serVice company in order to set up and market a so-called
affinity group bankcard for interested supporters of the
Party. The Company would contract with a bank to issue the
card and service the card users' accounts. In return for its
participation in this arrangement, which includes use of the
Party's name and mailing lists, the Party would receive a
royalty or license fee.
