Are classified employees whose most recent
employee performance evaluations were un-
satisfactory, entitled to a 9.5 percent
salary increment effective July 1, 1980?
Yes.

You wished to know whether an employee who
received an unsatisfactory performance evaluation during the
period of January 1 - June 30, 1980 was entitled to receive
the full 9.5% salary increase provided for State employees
in the 1981 Annual Appropriations Act on July 1, 1981. (62
Del. Laws ch. 277, the Act)
Under normal Merit System practice, each
employee was evaluated on the anniversary date of his employment.
Merit Rule 5.0810. If the employee received an unsatisfactory
