OPINION NO:    80-F013
QUESTION:      1)  Under what conditions and on what issues
may the Governor's Council on Labor hold
executive sessions given the provisions
of 29 Del. C. S10004 et. seq.?
2)   What protLures must the Governor's Council
on Labor follow in entering into executive
session?
ANSWER:        1)  The Gove:nor's Council on Labor may go
into executive session to discuss and
where appropriate vote only on the subjects
listed in 29 Del. C. S10004(b).
2)   Before going into executive session, the
Council must announce the specific basis
for going into closed session and affirmatively
vote to do so.
DISCUSSION:
You have asked on what issues and pursuant to what
procedures may the Governor's Council on Labor enter into
executive session to conduct public business.
Twenty-nine Del. C. S10001 et. seq. (commonly known
as the Freedom of Information Act, hereinafter Act) governs
public access to the meetings and records of all public bodies
carrying out public business. The declared policy of the
