SUBJECT: LEGAL REQUIREMENTS FOR A MEET AND CONFER SES-
SION-A meet and confer session held pursuant to Government Code
Section 3505 is not required to be open to the public. Tape recording equip-
ment may be used if both sides agree.

The Honorable John F. Hahn, County Counsel, Amador County, has requested
the opinion of this office on the following questions:
1. Is a meet and confer session held pursuant to Government Code section
3505 between representatives of a county employee association and representatives
of the board of supervisors, including no more than two members of said board of
supervisors, required by law to be open and public?
2. If not, must the representatives of the board of supervisors allow the tape-
recording of the session by representatives of said employee association?
The conclusions are:
1. Such a meet and confer session is not required to be open to the public.
2. There is no legal requirement that the employee representatives be allowed
to tape-record the session. Such matter appears to be one to be settled between both
sides in establishing the ground rules for the session.
