SUBJECT: ADVERTISING IN BARTENDER'S UNION HALL-A violation of
the Alcoholic Beverage Control Act occurs when a distilled spirits wholesaler
pays $100 per month to maintain a sign in a bartender's union hall, to encour-
age and promote the sale of alcoholic beverages sold by the wholesaler.

The Honorable Edward J. Kirby, Director of the Department of Alcoholic
Beverage Control, has requested an opinion on the following question:
Whether a violation of section 25503, subdivision (d) of the Alcoholic Bever-
age Control Act occurs when a distilled spirits wholesaler maintains a wallboard
sign in the union hall of the bartender's union and pays $100 per month for the
privilege.
The conclusion is:
A violation of section 25503, subdivision (d) of the Alcoholic Beverage
Control Act occurs when a distilled spirits wholesaler pays $100 per month for the
privilege of maintaining a wallboard sign in a union hall of a bartender's union,
and the sum is paid to the union to encourage and promote the sale of alcoholic
beverages sold by the wholesaler.
