Dear Mr. McCuen:
This is in response to your request for an opinion regarding the minimum
corporate franchise tax. You have posed the following specific two-part question:
What is the correct amount of the minimum corporate
franchise tax and the appropriate disposition of any
excess tax determined to have been collected?
In response to the first part of your question, it is my opinion that the correct
amount of the minimum corporate franchise tax is $59.00.
Acts 1987 (1st Ex. Sess.), No. 29, § 1, codified at A.C.A. § 26-54-104(a), provided
for an increase in the minimum corporate franchise tax from $17.00 to $50.00. In
1993, section (b) was added to A.C.A. § 26-54-104, providing for an additional
$3.00 charge. This charge was designated for funding the Signature Imaging
System. S= Acts 1993, No. 1285, §§ 3 and 4.
Your question appears to focus on the provisions of Act 50 of 1993, which
authorized funding for certain highway and transportation projects. The specific
inquiry seems to be whether Act 50 provides for a $6.00 charge in addition to the
minimum charge provided for in A.C.A. § 26-54-104.
