Dear Wendell:
This office acknowledges receipt of your letter on behalf
of the Arkansas Arts and Humanities Advisory Council requesting
an opinion on the following questions.
(1) Under the legislative scheme which governs
the Office of Arkansas State Arts and Human-
ities, is the Executive Director accountable
to the Advisory Council for administering
the provisions of the Act and related sub-
stantive functions?
(2) Does the legislative scheme which governs
the Office of Arts and Humanities authorize
the Executive Director to engage in actions
which contradict or circumvent policies, pro-
cedures, rules, or regulations promulgated
and adopted by the Advisory Council?
(3) Is the Executive Director authorized under
the existing law to disregard the Advisory
Council in administering the provisions of
the Arkansas State Arts and Humanities Act
of 1971?
(4) The Office of Arkansas State Arts and Human-
ities was transferred in 1975 to a newly
created Department of Arkansas Natural and
Cultural Heritage. To what extent, if any,
did that transfer diminish the powers, duties,
and responsibilities of the Advisory Council
or alter the legal relationship between the
Council and the Executive Director of the
Office of Arts and Humanities?
