Dear Mr. Turner:
This is in response to your inquiry wherein you submitted the
following:
(1) Does a County Board of Education have any juris-
diction, responsibility, or administrative
functions with a County District that has a three
(3) member elected board, other than what Arkansas
Law directs to and with regular formed districts?
(2) Many school districts employ administrative and
supervisory personnel on a two or three year con-
tract. Under a recent decision rendered by the
Arkansas Supreme Court, to the effect that School
Boards could only employ or issue contracts for
one (1) year at a time, are these multi-year con-
tracts still binding? Did this decision only
cover class room teachers?
I am aware of no obligations imposed upon the county board of
education relative to a school district with a three member board
other than what the statutes provide.
Regarding your second question, the Supreme Court decision to
which you refer appears to be Nethercutt vs. Pulaski County
Special School District, 251 Ark. 836 (January 24, 1972). The
case involved the school districth teacher tenure policy and
the statute involved was Ark. Stat. Ann. S 80-1304(b) only.
Act 145 of 1949 .codified as Ark. Stat. Ann. S 80-1236 authorizes
three year contracts and reads as follows:
From and after the effective date of this Act,
local school boards may employ department heads,
