Dear Mr. Twyman:
This is in response to your recent inquiry wherein you ask the
following questions:
Ark. Statutes 76-344B (Municipal Aid Fund) and 76-704
(County Road Tax) provides revenues to be credited to
the Street Fund of the first and second class cities
and incorporated towns. The Municipal Aid revenues
shall be used for the maintenance, construction and
reconstruction of the streets which are not a contin-
uation of the State Highways and the County Road Tax
collections for use in making and repairing the streets
and bridges in the respective cities and towns.
May these funds be used to pay a portion of the admin-
istrative salaries, such as, Mayor or City Manager's
salary and City Clerk or City Clerk/Treasurer's salary?
Would revenues from other sources, credited to the
Street Fund, be restricted in their use for payment
of a portion of the administrative salaries referred
to in the previous question?
In answer to your first question, we are unable to reconcile
salaries of administrative officials with maintenance, con-
struction and reconstruction of streets.
In answer to your second question, revenues from other sources
which have been credited to the Street Fund cannot be routinely
or systematically used for the payment of such administrative
salaries. Ark. Stat. Ann. 19-4423.
