Dear Sir:
This vill acknowledge receipt of your letter of June 25,
1968. in which you state:
Enclosed you will find photocopies of minutes of
the council meetings and copy of Ordinance No.
231, which amends Ordinance No. 7, to provide
for the appointment of the City Marshall.
Heretofore the City Marshall had been an elective
office, and we have two qualified persons running
for the office now. We have been advised that a
petition has been filed to refer this Ordinance
No. 231 to the people for a vote. The County
Clerk advises us that he certified the petition
containing the names as qualified voters of the
City of Gurdon and there was no question as to
the sufficiency of the signers of the petition.
In view of the fact that the matter will not be
voted on until the November election, and we have
no way of knowing the outcome, won't we still
have to have the two candidate's names appear on
the ballot for July 30th?
The Arkansas Constitution, Amendment 7, provides in part that
any measure referred to the people by referendum petition
shall remain in abeyance until such vote is taken. There-
fore, the ordinance providing for the appointment of the City
Marshal cannot take effect until. it is approved by the voters.
