Dear Mr. Thompson:
Your recent request for an opinion in reference to the
residency requirements for entrance to the University of
Arkansas School of Medicine has been assigned to me for
response.
In that request you set forth the followings
Act 139 of 1957 sets forth the general admission
requirements for the University of Arkansas School
of Medicine. In the past, this Act has been inter-
preted as meaning that only residents of Arkansas
are eligible for admission though the term resident
is not used (and I think fairly so). Recently, however,
an interpretation has been placed upon the Act -which
would deny admission to those mho were not possessed
with the political rights of United States citiaenship
though they be residents of the State of Arkansas -
the premise being that one cannot become a resident
of Arkansas unless he is a United States citizen.
Your opinion is respectfully requested upon the
propriety of such an interpretation. Specifically*
must one possess United States citisenship in
order to be a resident of the State of Arkansas
for purposes of Act 139 of 1957, and is sach citisen-
ship a pre-requisite for admission to the School of
Medicine under the Act?
