handle is hein.psc/nbrunseg2020 and id is 1 raw text is: P-22.1 NEW BRUNSWICK REGULATION 2020-1 under the PROVINCIAL OFFENCES PROCEDURE ACT (O.C. 2020-4) REGLEMENT DU NOUVEAU-BRUNSWICK 2020-1 pris en vertu de la LOI SUR LA PROCEDURE APPLICABLE AUX INFRACTIONS PROVINCIALES (D.C. 2020-4) Filed February 5, 2020 1 New Brunswick Regulation 91-50 under the Pro- vincial Offences Procedure Act is amended by adding after section 4 the following: 4.1 For the purposes of subsection 16.1(1) of the Act, only persons employed in the Civil Service may be ap- pointed ticket reviewers. 4.2(1) For the purposes of section 16.2 of the Act, all offences under the Motor Vehicle Act are specified to be prescribed offences other than (a) offences under sections 105.1, 345 and 346 of that Act, and (b) offences that are created by by-laws made by a local authority under that Act and that are not ap- proved by the Lieutenant-Governor in Council. 4.2(2) The following persons are authorized to serve a violation ticket under section 16.2 of the Act: (a) in respect of prescribed offences specified in subsection (1), peace officers as defined in the Motor Vehicle Act; and Depose le 5 fevrier 2020 1 Le Reglement du Nouveau-Brunswick 91-50 pris en vertu de la Loi sur la procedure applicable aux in- fractions provinciales est modifie par l'adjonction de ce qui suit apres l'article 4 : 4.1 Aux fins d'application du paragraphe 16.1(1) de la Loi, seuls les employ6s de la Fonction publique peuvent etre nomm6s examinateurs de billets. 4.2(1) Aux fins d'application de l'article 16.2 de la Loi, constituent des infractions prescrites toutes celles que pr6voit la Loi sur les vehicules d moteur, sauf : a) celles que pr6voient les articles 105.1, 345 et 346 de cette loi; b) celles qui sont 6tablies par arret6 que prend une collectivit6 locale en vertu de cette loi et que le lieutenant-gouverneur en conseil n'a pas approuv6es. 4.2(2) Les personnes ci-dessous nommdes sont autori- s6es a signifier des billets de violation en vertu de 1' arti- cle 16.2 de la Loi : a) relativement aux infractions prescrites pr6vues au paragraphe (1), les agents de la paix selon la defini- tion que donne de ce terme la Loi sur les vehicules d moteur; 1 Provincial Offences Procedure Act 9pb e 2020-1
