handle is hein.pio/hlbamaaqqa0001 and id is 1 raw text is: Civil Aviation Bill EXPLANATORY AND FINANCIAL MEMORANDUM The purpose of the Bill is to establish two new public bodies -a Civil Aviation Authority whose task will be to regulate the British civil aviation industry as a whole and a British Airways Board charged with the overall management of the public sector airlines. The Bill also makes new provision for the regulation by the Secretary of State of noise and vibration from aircraft The Authority will take over functions now exercised by the Air Transport Licensing Board and the Air Registration Board together with a range of civil aviation functions at present per- formed by the Secretary of State. It will undertake the licensing of air transport services and will regulate the safety of civil aviation operations and the airworthiness of the aircraft employed. It will also operate some aerodromes and, jointly with the Secretary of State for Defence, will run the National Air Traffic Services. The Authority will be guided in the exercise of its functions by the objectives set out in the Bill together with such other guidance as the Secretary of State may give it with the approval of Parliament. The British Airways Board will exercise control over B.O.A.C. and B.E.A. and their subsidiaries as a group so as to develop the group's services and use its resources to the best advantage. The group will be subject to economic and safety regulation by the Authority in the same way as any other airline group. The Bill provides for the dissolution of the Air Corporations in certain circumstances but only with the prior approval of Parliament. PART I THE CIVIL AVIATION AUTHORITY Clauses 1 and 2 lay down the constitution and functions of the Authority which is declared not to be the servant or agent of the Crown. Clause 3 requires the Authority to perform its functions in the manner which it considers best calculated to achieve the objec- tives which are set out in the clause and to accord with guidance which the Secretary of State may give to the Authority with the approval of both Houses of Parliament.
