  The text of the Fourth Preliminary Report of the Advisory Committee
on Practice and Procedure, which was submitted on January 2, 1960, ap-
pears on the following pages.
  The Advisory Committee was established by the Temporary Commission
on the Courts in 1955 for the purpose of undertaking an over-all study
and revision of the statutes and rules relating to civil practice and pro-
cedure. Although the Commission was abolished effective March 31, 1958,
the work of the Advisory Committee has been continued with legislative
contingency funds made available by the Senate Finance Coninittee and
the Assembly Ways and Means Committee.
  The text of the First Preliminary Report (1957 Legislative Document
No. 6(b)) was printed in Pamphlet No. 4 of McKinney's 1937 Session Law
