To: Drafting Committee on Collaborative Law Act
CC: Observers
From: Peter Munson
Re: Preparation for Drafting Committee Meeting November 21-22, 2008 Portland,
Oregon
Date: October 7, 2008
You will receive a detailed agenda and background material before the meeting. I
thought, however, I would give you an early indication of what we will be discussing with the
enclosures to this memorandum.
(1) First reading transcript- We had a very productive first reading of the Collaborative
Law Act at the ULC annual meeting in Big Sky in July. I enclose a PDF file of the
transcript for your information. As you will see, the floor discussion raised a number of
new issues and many which we discussed previously.
(2) Research agenda- Enclosed is a memorandum from Andy to his law student research
team describing the tasks he anticipates that the research team will accomplish before the
November meeting. Andy identifies a number of key issues on which his students will
draft short background memoranda before our meeting. The memos will be transmitted to
you before the November meeting. The issues listed in Andy's memo are likely to
constitute a major portion of our agenda for the November meeting.
Another purpose of this memorandum is to introduce you to Yishai Boyarin, an LL.M.
student at Hofstra Law. Yishai graduated from UC Berkeley Law in 2004 and worked for the
Orrick firm as a business litigator for three years. His LL.M studies are concentrated on
collaborative law. Yishai is assisting Andy in the research and drafting of the Collaborative Law
Act. He will be joining us at the Portland meeting. He can be reached by e mail at
xboyariniyahoo.com.
If you have any questions, comments or reactions to the enclosures please feel to contact
me, Andy or Yishai or all of us.
I look forward to our meeting in Portland and continuing to make progress on developing
the Collaborative Law Act.
