INTRODUCTION
In the 1990's, we were warned that a new breed of young
superpredator was at large in America, committing depraved acts of
brutality seemingly for sport.' In 1996, John J. Dilulio, Jr. coined the
term superpredators in his theory around the notion that a new
generation of street criminals is upon us-the youngest, biggest and
baddest generation any society has ever known.2 Now as the director
of the White House Office of Faith-Based and Community Initiatives,
he has retracted his theory, which had incorrectly predicted these
superpredators would sharply increase the level of teenage violence
,,3
by the turn of the century.  In fact, juvenile crime has been decreasing
since 1995, yet the media persists in making it seem as though it has

gotten worse.
In this paper, I will argue that the trend in the United States
towards increasingly aggressive waiver and transfer laws of juveniles
into adult court has resulted in the creation of more, and younger,
convicted criminals who are unable to successfully reintegrate into
society as productive citizens.
