Torture in the Law of the Fifty American States: Searching
for Definition*

Abstract
Torture is the subject of considerable
contemporary debate on both the national and
international stages. In particular, questions
regarding torture appear in a number of
settings related to the current War on
Terrorism. A significant aspect of this debate is
the definition of torture: just what is torture or
a tortuous act? This study examines how
American states have viewed torture within
the context of their own laws and offers

based on a presentation made at the Annual Meeting of the Academy of
Criminal justice Sciences held in Seattle, Washington in March 2007. An
earlier related version was presented at the Annual Meeting of the
Southern Political Science Association held in New Orleans, Louisiana in
