Resumen: El concepto de posesi6n, su rdgimen juridico y sus formas de proteccion en el
Derecho foral hist6rico valenciano, concretamente en los textos de los Furs de Valencia,
ofrecen uno de los ejemplos mis claros de la recepci6n de ideas y formas del Derecho
romano reinterpretadas por la labor de los juristas del ius commune, sobre todo, en este caso,
por la ampliaci6n del concepto de possessio y de su defensa, operada por el Derecho
can6nico medieval e informado por el principio spoliatus ante omnia restituendus que, desde
su aplicaci6n a oficios y beneficios eclesiasticos, a derechos senoriales como poder
jurisdiccional, incluso tambidn a derechos que hoy calificarfamos de cargas reales, y tambidn
a los derechos del c6nyuge sobre la comunidad matrimonial, se extiende a la tutela sumaria
de la simple posesi6n de una cosa a favor de quien ha sido expoliado. En particular, se
analizar4 c6mo el denominado canon Redintegrada del Dereto de Graciano, asi como las
Decretales de Gregorio IX, en particular, el titulo XIII del libro II cuya rdbrica reza De
restitutione expoliatorum, se integran en los textos de los Furs de Valencia a los efectos de
la protecci6n sumaria de la posesi6n.

Abstract: The concept of possession, its legal regime and its forms of protection in the
Valencian Historical Foral Law, specifically in the texts of the Furs de Valencia, offer one
of the clearest examples of the reception of ideas and forms of Roman Law reinterpreted by
the work of the jurists of the ius commune, especially, in this case, due to the expansion of
the concept of possessio and its defense, operated by medieval canon law informed by the
principle spoliatus ante omnia restituendus that, since its application to ecclesiastical offices
and benefits, to manorial rights as a jurisdictional power, even also to rights that today we
would qualify as real charges, and also to the rights of the spouse over the matrimonial
community, it extends its influence to the summary protection of the simple possession of a
thing in favor of who has been plundered. In particular, it will be analyzed how the so-called
Canon Redintegranda of the Decretum Gratiani, as well as the Decretals of Gregory IX, in
