Ehimwenma Joyce Iyamu discusses various interpretations of public use and the evolution of the public
use doctrine with Kelo v. City of New London. Kelo exemplifies that states, not federal courts, can and must
protect the rights of private land owners as required by the United States Constitution. Joyce recommends
that the Texas Legislature, in order to protect private property owners, propose a constitutional amendment
prohibiting (with exceptions) takings of private property for economic development as a public use.
