THE INTOXICATION DEFENCE: IN A FRENZY OF
BAKCHEIA'

should, with joy, pleasance, revel and applause, transform ourselves into beasts!2
I.     INTRODUCTION
The intoxication defence in the Penal Code' resembles a rosewood pagoda situated
in a tropical climate: sacrosanct in its structure of legal principles but ephemeral
and susceptible to the rot of hard cases. One realises. reluctantly, that this rosewood
pagoda simply does not belong here. This article seeks to tap on the provision and
ascertain the hollowness and deficiencies of its structure. It shall then assess no less
than four possible reforms of the intoxication defence, from the extreme conservative
end of the spectrum to the extreme liberal end. Lastly, this article shall piece together
a refurbished halfway house that may provide a viable solution to this piece of bad
architecture.
The current provisions for the intoxication defence read as follows:
Intoxication when a defence.
85. -(1) Except as provided in this section and in section 86, intoxication
shall not constitute a defence to any criminal charge.
(2) Intoxication shall be a defence to any criminal charge if by reason thereof
the person charged at the time of the act or omission complained of did not
know that such act or omission was wrong or did not know what he was doing
and -
(a) the state of intoxication was caused without his consent by the
malicious or negligent act of another person; or
(b) the person charged was, by reason of intoxication, insane, temporarily
or otherwise, at the time of such act or omission.
