ABSTRACT
This study, in three parts, is dedicated to the bankruptcy crimes, simple and
fraudulent, and regulated by articles art. 240-241 pf the Penal Code. This third part
approaches the fraudulent bankruptcy crime. The active subject, although, dejure,
not qualified, defacto is an executive within the debtor-legal person. Legal object is
analyzed through the constitutive content of the infraction, which regulates three
alternative ways of accomplishment. Based on the way of accomplishment, out
of the three ways possible, the crime is of danger or of result. From the subjective
aspect, the crime is accomplished only with direct intention, qualified by purpose.
At the end, the infraction of fraudulent bankruptcy is analyzed by comparison
with other infractions, with an identical or partially identical content: forgery in
private signed documents, abuse of trust by fraud to the creditors, fraudulent
management, and tax evasion.
