LAS DISTINTAS COMUNIDADES AUTONOMAS

Resumen

La reciente Ley 27/2013, de 27 de diciembre, de Racionalizaci6ny Sostenibilidad de la Administraci6n Local (LRSAL)
suscita importantes y complejas cuestiones desde la perspectiva de la validez competencial de la propia ley y de su
aplicacion en las distintas comunidades autonomas. Estas cuestiones se ejemplifican, fundamentalmente, en el nuevo
regimen  de competencias municipales y provinciales. En terminos generales, la nueva ley contiene una notable
recentralizacion del regimen local, lo que pugna con las diversas competencias auton6micas y, posiblemente, excede
de la propia competencia bisica estatal ex art. 149.1.18 CE. Por otro lado, a la espera de que se clarifique la validez
constitucional de la nueva ley, en muchas materias las Administraciones Locales se encuentran con leyes auton6micas
o preceptos estatutarios abiertamente contradictorios con los preceptos de la nueva LRSAL. Siguiendo la jurisprudencia
constitucional, nada autoriza a las Administraciones Locales a inaplicar con caracter general las leyes auton6micas, a
favor de la LRSAL.

THE   NEW  GENERAL LOCAL GOVERNMENT REGULATION AND ITS DIFFERING APPLICATION IN
THE   DIFFERENT   AUTONOMOUS COMMUNITIES

Abstract

The recent Act 27/2013 of 27 December on the Streamlining and Sustainability of Local Government (LRSAL) raises
important and complex issues from the perspective ofits validity and implementation in the different regions (autonomous
communities). These issues are exemplied mainly in the new system of municipal and provincial powers. Overall, the
new  law contains a remarkable recentralization of local government, which conflicts with the various powers of the
autonomous  communities and possibly goes beyond the basic jurisdiction of the central State, according to article
149.1.18 of the Spanish Constitution. On the other hand, while waiting for clarifcation of the constitutionality of the
new  law, many local governments face regional laws or statutory precepts that clearly contradict the precepts of the
new LRSAL.  In accordance with the case law on constitutional issues, nothing authorized local authorities to generally
fail to apply laws of the autonomous communities while giving precedence to the LRSAL.
