            RETROSPECTIVE ET PROSPECTIVE
         SUR LE CONTENTIEUX ADMINISTRATIF

       L'auteur offre une synth(se critique de l'dvolution du contentieux
 administratif en droit canadien au cours de quarante dernidres anades et il
 s'interroge sur lesfacteurs susceptibles d'en changer la teneur a l'avenir. Il
 identifie les avancies qui lui paraissent avoir &t les plus importantes et
 les plus ficondes 6 la fin du Xe sidcle, dont l'dmergence du pluralisme
 interprdtatif, et il soutient que l'apport tout 6 fait innovateur d'un grand
 arret de la Cour supreme du Canada en 1978  n'a pas &t exploit6 par les
juristes autant  qu'il mdritait de l'etre. Cela explique, selon lui, le
ddveloppement  par moment   chaotique de la jurisprudence en matibre de
contrdlejudiciaire. Il examine ensuite les tendances socidtales actuelles qui
transforment  la  nature  de  'action gouvernementale,  ainsi  que  les
rdaminagements rdcents, institutionnels et autres, en droit public
canadien  et plus spdcifiquement qudbicois.

       Focusing  on  the  judicial review  of administrative action  in
 Canadian  law, the writer offers a critical account of its evolution over the
 last forty years and considers those developments which  may  alter its
 course in a foreseeable future. He lists what were in his view the most
 significant and fertile changes in the latter part of the XXth century,
 insisting on the emergence of interpretive pluralism. In the writer's opinion,
 a major innovation brought in by a leading case of the Supreme Court of
 Canada  in  1978  has not  received from the legal profession the full
 measure  of attention it merits; this neglect would   account for the
 sometimes chaotic state of the jurisprudence on judicial review. The writer
 then turns his attention to current societal trends and their impact on
 governmental action. Recent institutional and substantive changes may
 also reconfigure public law in Canada and, more specifically, in Quebec.
