       Cet article retrace les origines lointaines de la loi qu6b6coise sur la
protection de la jeunesse  depuis les premibres dispositions l6gislatives
britanniques et am6ricaines prot6geant l'enfant victime de mauvais traitements
par les sphres publique et priv6e. II analyse les motifs, parfois int6ress6s, ayant
pouss6 l'Etat A intervenir progressivement dans la cellule familiale pour secourir
l'enfant maltrait6. II d6crit aussi la manibre dont le droit britannique a influenc6
les lois canadiennes de sauvegarde de l'enfance, notamment dans les provinces
de l'Ontario et du Qu6bec. Enfin, il 6tablit une corr6lation entre le moddle
traditionnel d'assistance sociale au Qu6bec et la reconnaissance tardive de
l'enfant comme sujet de droit.



       This article retraces the distant origins of the Quebec Youth Protection
Act to the earliest British and American laws protecting the child from social
and family maltreatment. It analyses the State's interested motives in intervening
progressively in the family unit to rescue the abused child. It also describes how
British laws influenced Canadian child protection legislation, notably in the
provinces of Ontario and Quebec. Finally, it establishes a correlation between
the traditional model of public assistance in Quebec and the late recognition of
children's rights.
