ROMER V. EVANS
Amendment 2 to the Colorado constitution bars state and local
governments from passing any law protecting homosexuals from
discrimination unless and until another amendment passes rescinding
Amendment 2. The Colorado Supreme Court held that Amendment 2
unconstitutionally burdens the fundamental right to participate equally
in the political process. Now, the Supreme Court decides if there is such
a right and, if so, whether it is violated by the Amendment.
NATIONAL LABOR RELATIONS BOARD V.
TowN & COUNTRY ELECTRIC, INC.
Union members often secure jobs in nonunion businesses to organize
the workforce. While so employed, the union makes up any difference
in wages and benefits. Is such a union-sponsored employee protected by
federal labor laws? That question has divided lower federal courts and is
now before the Supreme Court for a definitive decision.
BMW OF NORTH AMERICA, INC. v. GORE
BMW repainted Ira Gore's 535i and sold it to him as new.
When he found out, he sued in his home state of Alabama and won
$4,000 in actual damages and $2 million in punitive damages.
The punitive damage award was based largely on BMW's repair
practices nationwide, not just in Alabama. Here, the Court decides if
out-of-state actions can be considered in awarding punitive damages.
