Advice to the General Practitioner
Lawyers Must Look for Danger Signals When
Counselling Aliens and Immigrants

In this age of increasing specialization in the practice of law, one of the
fastest growing specialities is immigration and nationality law. Since
1952 the immigration and nationality laws have proliferated, aliens by
the millions have entered the United States legally and illegally, and the
number of attorneys specializing in this field has burgeoned. Courses on the
subject are now offered at leading law schools throughout the country and
there is a robust national bar association, the American Immigration Lawyers
Association, which has over 1,600 members.
Added to the ever growing number of statutes and regulations on the
subject is their increasing complexity. As one court recently observed:
If the words physically present are to be taken literally, it is obvious that the aliens meet
this requirement. However, we are in the never-never-land of the Immigration and
Nationality Act, where plain words do not always mean what they say.'
Another court said:
Whatever guidance the regulations furnish to those cognoscenti familiar with INS
procedures, this court, despite many years of legal experience, finds that they yield up
meaning only grudgingly and that morsels of comprehension must be pried from mollusks
of jargon.2
