VOLUME 24 CASES 1-48 ISSUE 1 1972

Zoning Digest

HIGHLIGHTS OF THIS ISSUE

Mobile Home
Mobile home parks are a preferred use in Michigan; a city ordinance excluding mobile home parks is
not presumed to be valid. The burden is upon the municipality to justify the ordinance in light of the
needs of the neighboring communities as well as its own. Bristow v. City of Woodhaven, 24 ZD 1.

Constitutional Law
The Tahoe Regional Planning Compact that established the Tahoe Regional Planning Agency for the
purpose of planning, conservation, and resource development and imposed a duty on the part of
counties to pay for the support of the agency's activities does not violate the California Constitution
which confers broad powers over purely local affairs upon local government bodies. People ex rel.
Younger v. County of El Dorado, 24 ZD 2.

Rezoning
For a rezoning ordinance to be upheld in Delaware, it is sufficient that the ordinance is not arbitrary
and capricious and that it is reasonably related to the public health, safety, or welfare. Willdel Realty,
Inc. v. New Castle County, 24 ZD 3.

Subdivision
The town planning board may limit the number of plots in a subdivision in order to reduce the risk of
pollution to a unique pond located outside the confines of the subdivision. Landing Estates, Inc. v.
     Jones, 24 ZD 4.

Rezoning
Rezoning from commercial or light industrial to multiple dwelling classification in furtherance of the
city's general development plan was improper because it caused a hardship for certain property
owners. F.H. Uelner Precision Tools and Dies, Inc. v. City of Dubuque, 24 ZD 5.

Occupancy Regulations
Prohibition of group rentals found in zoning ordinance was too broad and not reasonably related to
the proper objectives of the zoning power. Kirscb Holding Company v. Borougb of Manasquan, 24
     ZD 6.

                                                                                          Page
