HOSPITAL HOMICIDE CASE.

This case, recently tried in this city, has brought the
question of medical expert evidence once more promi-
nently before the public. The accused was a nurse in
charge of the Insane Pavilion, and he was charged with
having caused the death of a patient through violence.
Three witnesses testified for the prosecution that they saw
the accused nurse strike the patient Hilliard, and pull on
a sheet which he had placed around Hilliard's throat.
The accused nurse, Davis, as a witness in his own behalf,
admitted that he had used restraining force upon Hilliard,
and that he had slapped him. The defense was that Hil-
liard did not die from the effects of the violence.
In no recent case has the issue of the defendant's guilt
been so entirely dependent on medical expert evidence as
in this case. The defence examined eight medical wit-
nesses, and amongst them were men of the highest stand-
ing in the medical profession. The prosecution, not to be
left too far in the number of medical expert witnesses,
examined five experts, and amongst them were also
men in the front rank of the medical profession. The
experts on one side differed from those on the other-
this is not unusual; but to emphasize their differences,
the District attorney described the testimony of the expert
witnesses as a race of liars.
