FOREWORD
The Rt. Hon. The Lord Woolf
I am delighted that the Liverpool Law Review has decided to devote
an issue to the reform of civil justice. What is required more than
anything else in England and Wales is a change of culture. A change
from a culture in which civil litigation is regarded as all out warfare or a
fight to the death to an approach which accepts that civil justice is
primarily concerned with dispute resolution and this should happen in a
rational and reasonable way.
I recognised that we had a lot to learn from other jurisdictions.
Traditionally in this country, when we are prepared to learn from
elsewhere, we confine our attention to what is happening in other
common law jurisdictions. This is a mistake. It is particularly a mistake
with regard to civil procedure. The civil justice systems on the continent
provide a real alternative against which what we do in this country needs
to be compared. I am therefore particularly pleased that the Review
looks at what is happening in France and Germany and also Scotland.
As to the article by Charles Stoddart entitled Can the Scots Learn From
Woolf? I would not suggest that they can but I am able to say that I
learnt from the Scots! In any comparative exercise we in England should
start off by crossing the border.
The articles in the Review make a substantial contribution to the
agenda of reform and I congratulate all those involved for their most
valuable contributions.
