PATENT FOR INVENTION FROM THE RESTORATION
TO 1794.
L
N July, :i9o% I suggested in these pages that an examination of
the Records of the Privy Council would probably yield material
for a history of Patent Law from the Statute of Monopolies to
Dollond's case (1766), this period being almost barren of recorded
Common Law decisions. The removal of these Records from
Whitehall to the Record Office has enabled me to carry out this
investigation for the greater portion of the period concerned, and
I now submit the results to the consideration of those curious in
these matters.
The material collected has been arranged in chronological order,
and is probably a complete record of revocation cases by the
Council for the period covered. I have, however, included all
cases of Patent Law procedure calculated to throw light upon the
practice of the Crown in the regulation of its grants. Unless
otherwise stated, the authority for my statements must be under-
stood to be the Registers of the Privy Council; but collateral
sources have been freely utilized: for the Council, not being an
Office of Record, allowed its papers to stray freely into other
colections, public and private. Where a patent is not represented
in the Official Series a reference to the Patent Roll has been given.
It will be seen that the Official Series is far from complete for the
early years of the Restoration period. A list of Cromwellian
patents compiled by Mr. Rhys Jenkins, of the Patent Office, will
be found in Notes and Queries, II S., vii, p. 163.

drain mines. In 1663 James Streete obtained a patent (.Patent
Roll, 15 Car. II, pt. ix, No. 8) for the same purposes. In the recital
of the latter patent it is alleged that Treswell had obtained an
insight into the mill erected by Streete, and by other intercourse
with him had presumed to erect a mill conducing to the same
effect, but had not been able to perform the same, and that Streete
