Presenting Trm 3 Lies to a Jur yo

The Unfolding Method

by Constance Bernstein

Jurors remember 80% of what they see versus 20% ol what they hear.
And yet, instead of mapping out a visual trial up front and integratin g it into
the case strategy, attorneys too often wait until the last moute to throw to-
gether a few blow-ups of documents. And they call that thqr visual trial!

Communicating in the courtroom is difficult enough, with all the ritu-
als, rules and procedures which inhibit juror comprehension. Attorneys need
all the help they can get to communicate more effectively in that arena. Visu-
als provide attorneys that opportunity. And yet, too often, the first cuts made
in a limited budget are for visuals.

picture. And the picture is that most folks learn by seeing, not hearing.

                                       7 comprehension and retention.

The golden rule in designing
a visual trial is: one idea, one
visuaL Although this is the
most important rule, it is also
the one most violated. How
many times have you been in
the courtroom when your
opponent put up a 30 x 40
poster board filled from top to
bottom with important
points-one right after the
other. And while the attorney
