      AFGHANISTAN: ADMINISTRATION OF
              JUSTICE UNDER TALIBAN
                        (1996  -  2001)

   Abdul  Latif*, Fayyaz Ur Rehman**,  Inayat Ullah Khan***

Kabul  was captured by Taliban on 27 September  1996 without any
significant resistance. Dr. Najeeb Ullah, Ex Afghan President and his
brothers, were killed on the spot, after remaining under refuge, in UN
Headquarters Kabul for more than four years. Mullah Muhammd Omar,
Amir  Ul Momineen,  established a six members ruling Shura_ Mullah
Muhammad Rabbani was assigned administration of Kabul, Mullah
Muhammad Hassan was made Minister of Police and Border Areas,
Mullah Abdul Razzaq  Minister of Defence, Mullah Syed Ghias Ud Din
Minister of Education, Mullah Muhammad  Ghaus Minister of Foreign
Affairs and Mullah Muhammad Fazil   Minister of Security2. Taliban
administration in their First Communications, declared enforcement of
Islamic Laws  including rights of women   as basic policy of the
government'. They remained committed  to implementation of Islamic
Laws  and rules, with revolutionary spirit, ignoring international criticism
and protest. They did not care for criticism over deterrent punishments
and  restrictions imposed on women, under the Islamic Laws of the
Taliban'.

Role of the Judiciary

Amir  Ul Momineen  Mullah  Umer  termed administration of effective
justice to be top priority of the government. While reviewing the report
about administration of Justice, presented by Mullah Abdul Ghafoor
Sanaee, the Chief Justice, Amir Ul Momineen emphasized over solid
measures for providing immediate justice to the people, settling their
complaints and giving them remedy at the earliest. He instructed the
