Recent Developments in Internet Defamation Law

                                    Berkley D. Sells'

Abstract:

Internet defamation litigation is not the same as traditional libel litigation. Unique challenges facing
plaintiffs seeking a remedy for destroyed goodwill of a business or damage to reputation include:
anonymity of the author responsible for the defamation, cost of successfully tracking down the defendant
and jurisdiction issues. This article considers certain legal issues raised bythese unique problems and the
efficacy of solutions offered in countries such as the United States, Canada, the United Kingdom and
Australia.

' The author is a partner in the Toronto litigation department of Fasken Martineau DuMoulin LLP, a
leading business and litigation firm in Canada. With over 580 lawyers in offices in Toronto, Montreal,
Vancouver, Calgary, Quebec City, New York, London and Johannesburg, Faskens provides services to
clients in virtually all areas of law. The author acknowledges with thanks the contribution of Andrew
D. Newman, student-at-law at Faskens, to the preparation of this paper.
