Litigating Insurance Coverage Issues Under Aviation Liability
Policies - James B. Denman and John R. Benn 7
This article examines the trial problems involved in handling
insurance coverage issues that arise in general aviation
litigation. After discussing the basic aviation liability policy
and the defenses it provides, the authors consider the more
common policy conditions and exclusions and explain their
interrelationship with the trial defense based on lack of
coverage. They conclude by examining the trial practices
which might be utilized in defending the insurance coverage
issue and the tactical considerations involved.
