Products Liability: Res Ipsa Loquitur

Henry J. Reed

This doctrine of law leads through the maze of warranty,
express and implied, and through the maze of privity. The
author steers clear of the exploding bottle cases and examines
the decisions involving other products wherein the doctrine
of res ipsa loquitur is applied as a departure from the
,fundamental requirement that the offending instrumentality
be within the exclusive possession, control and management
of the party to be charged at the time of the injury. Mr.
Reed is claims attorney, Zurich Insurance Company, Chicago.
Recognition of Christian Science Treatment DeWitt John 18
In the December issue we carried an article which analyzed
several decisions of the courts in which the point of conten-
tion involved a Christian Scientist practitioner. ]Vow we are
glad to bring you an article out of the First Church of Christ,
Scientist of Boston, which maintains that as a healing
system Christian Science enjoys an increasingly favorable
position in the eyes of insurance companies and law makers,
We are happy to bring both sides of this question to the
attention of our readers.
