Introduction by the Special Editors, taken from their Opening and Closing words at 'Legal
Education and Scholarship - Past, Present and Future, a Workshop in Honour of
William Twining', 20th October 2010, Institute of Advanced Legal Studies, University of
London.
And there were giants walking the land
At least there were giants walking Warwick. It was 1974 and a rather raw, recently qua-
lified solicitor who had been a commercial litigator at the firm of Coward Chance
joined the Faculty of the Law School at the University of Warwick (dropping, in
doing so, more than two thirds of his salary).
There were giants. Patrick Atiyah would buy a couple of jam doughnuts at about
11.00 in the morning, go into the Law School common room, feed up on a bit of the
sugar and then let loose. It could have been a case decided the day before in the Court
of Appeal or the House of Lords but it was equally likely to be the tennis, some
element of politics or - anything. It was always unbelievably entertaining, the clearness
of thought, the amazing perception and the humour both obvious and unacknowledged.
And there was Patrick McAuslan, who had just been Head of Department and
William Twining, and a Geoffrey Wilson who had scattered some great books in
public law and legal system around everyone's bookshelves and had got together a
group of very special people.
Was Yash Ghai there then? Probably not quite yet. But the group who had gone
across to teach in parts of East Africa before settling into the Midlands were strong.
'Giants to be' such as Steve Anderman, Sol Picciotto, Mike Chesterman - even
Laurence Lustgarten were all there. And other giants, in terms of teaching ability,
included Tom Hervey, Philip Britton and others.
There was plenty to learn from - we grasshoppers were in awe. But Warwick was
not the sort of place where one remained in that condition. We queried, cavilled,
began to understand and finally developed. Until there was a starburst of giants
(and others) onto other intellectual stages and staging posts.
Legal Education was certainly not the only area in which William provided lea-
dership. But it was especially important to me and in the early days of our clinical
legal education programmes. He was enormously supportive but in his quiet way.
Somehow I began to learn and understand the links between the realist legal philoso-
phers and the movement towards clinical legal education. He took me under his wing
as we both flew to Florida for 'CLEPR's Last Stand' in Key Biscayne.
It was not just the intellectual life at Warwick that William led, but also the social
life. Penelope and William would invite the faculty round two or three times a year to
